When you are physically, mentally or emotionally harmed by someone, then you become eligible for a compensation for the same. The dispute might not be always very straight forward and may account the defendant’s negligence which caused damage to the plaintiff. Often such claims need the intervention of courts and legally such cases are referred to as personal injury settlement. The legitimacy of these cases has been debated many times since there are many factors taken into account while finalizing the reward, which cannot be quantitatively analyzed, e.g. emotional loss. Cases which may fall under this field are:-
• Physical injuries such as
o Road accident/ vehicular accident
o Accident at work (industrial accident)
o Claims of physical assault
o Injury arising out of defective products
o Medical accident/ negligence
o Industrial diseases
• Emotional injury
o Defamation
o Unjustified job termination
o Demotion in job
o Profanity
The above list gives some hints but by no means is exhaustive. A given personal injury settlement can take into account not only the direct effects of the injury, but also all the legitimate repercussions arising out of the injury. This is the very reason that sometimes, claim amounts can go up very high, running into six or seven digits.
Personal injury settlement has become a highly specialized branch of legal practices. While critics may debate over many aspects of this practice, there are hundreds of cases for reference. Special personal injury attorneys, who are experts in this area, are often employed to fight these cases. While the plaintiff’s attorney may try to increase the claim amount by associating as many damages as possible with the case; the defendant’s attorney fights his tooth and nail to rebuff these claims. The plaintiff may claim the reimbursement for attorney fee, legal expenses and other miscellaneous expenses from the defendant if he wins. One the other hand, defendants may slap punitive charges against the plaintiff if they win the case.
Since this area of law is very complicated, it may take years to resolve a single dispute. Many a times, it happens that both the parties come to realize that they are continually pouring in more money, more resources and more time into this fight which is causing them serious over head and thus, eventually opt for an out of court settlement. The settlement offer is prepared by the defendant and proposed to the plaintiff. The plaintiff may review the same and accept or reject it. An overwhelming majority of such cases get resolved out of court.
